Please read these Terms and Conditions ("Terms", "Terms and Conditions") carefully before using the Chess - Online & Offline mobile application (the "Service") operated by Apex Consulting AB ("us", "we", or "our").
Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users, and others who access or use the Service.
By accessing or using the Service you agree to be bound by these Terms. If you disagree with any part of the terms then you may not access the Service.
1. Accounts
When you create an account with us, you must provide us with information that is accurate, complete, and current at all times. Failure to do so constitutes a breach of the Terms, which may result in immediate termination of your account on our Service.
- Anonymous Accounts: You may initially use the Service via an anonymous guest account. You acknowledge that if you uninstall the App or clear your device data without first linking your account to an email address, your progress, stats, and purchases may be permanently lost.
- Account Security: You are responsible for safeguarding the password that you use to access the Service and for any activities or actions under your password. You agree not to disclose your password to any third party. You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.
2. Virtual Goods and Currency
The Service includes virtual currency ("Gems") and virtual items (e.g., "Avatars", "Streak Freezes").For the purposes of this Privacy Policy:
- License: Virtual goods and currency are licensed to you, not sold. You have a limited, non-transferable, revocable license to use them within the Service.
- No Monetary Value: Virtual currency and items have no real-world monetary value and cannot be redeemed for cash or other tangible goods.
- Purchases: All purchases of virtual currency or items are final and non-refundable, except as required by applicable law.
- Usage: We reserve the right to manage, regulate, control, modify, or eliminate virtual goods and currency at our discretion.
3. User Conduct and Online Play
You agree to use the Service only for lawful purposes and in accordance with these Terms.Personal Data
- Fair Play: You agree not to use chess engines, bots, or any other third-party assistance tools during gameplay. Cheating undermines the integrity of our matchmaking and league systems.
- Respectful Communication: You agree not to harass, abuse, or send offensive content to other users via direct messages or any other communication feature.
- Matchmaking: You understand that our matchmaking system pairs you with opponents based on an Elo rating system. You agree not to manipulate your rating by intentionally losing games ("sandbagging").
4. Leagues and Leaderboards
Participation in leagues is subject to the following rules:
- Placement: You are automatically placed into weekly leagues based on your activity.
- Rewards: We reserve the right to determine the criteria for XP calculation and league rankings.
- Disqualification: We reserve the right to disqualify you from leaderboards or leagues if we suspect cheating or manipulation of game results.
5. Intellectual Property
The Service and its original content (excluding Content provided by users), features, and functionality are and will remain the exclusive property of Apex Consulting AB and its licensors. The Service is protected by copyright, trademark, and other laws.
6. Termination
- By Us: We may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.
- By You: You may terminate your account at any time by using the "Delete Account" feature in the Settings menu. Upon termination, your right to use the Service will immediately cease, and all your data (including stats, friends, and purchases) will be permanently deleted.
7. Limitation of Liability
In no event shall Apex Consulting AB nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Service; (ii) any conduct or content of any third party on the Service; (iii) any content obtained from the Service; and (iv) unauthorized access, use or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence) or any other legal theory, whether or not we have been informed of the possibility of such damage.
8. Governing Law
These Terms shall be governed and construed in accordance with the laws of Sweden, without regard to its conflict of law provisions.
9. Changes
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material we will try to provide at least 30 days notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
