# Terms of Service
**Numi - Coin Collection & Identification**

These Terms of Service ("Terms") govern your use of the Numi mobile application ("App") operated by **Apex Consulting AB** ("we", "us", "our"), a company registered in Sweden.

By downloading, installing, or using the App, you agree to these Terms. If you do not agree, do not use the App.

## 1. About the App
Numi is a mobile application that allows users to:
- Identify and value coins using AI-powered image recognition
- Build and manage a personal coin collection
- Receive AI-estimated grades and market valuations
- Share coins and interact with a community of collectors
- Chat with an AI coin expert (Pro feature)

## 2. Eligibility
You must be at least 16 years old to use the App. By using the App, you confirm that you meet this age requirement. If you are under 18, you confirm that you have your parent's or legal guardian's consent.

## 3. Accounts
### 3.1 Account Creation
You may use basic App features without an account. Creating an account (via email, Google Sign-In, or Apple Sign-In) unlocks additional features including cloud sync, social features, and ad removal.
### 3.2 Account Security
You are responsible for maintaining the security of your account credentials. You must not share your account or allow others to access it. Notify us immediately at info@apexconsulting.se if you suspect unauthorized access.
### 3.3 Account Deletion
You may delete your account at any time through the App's Settings screen. Deletion is permanent and removes your profile, collection data, and posts from our servers.

## 4. Subscriptions & Purchases
### 4.1 Numi Pro
Numi Pro is an optional subscription that provides unlimited coin identifications, AI chat, and advanced insights. It is available as a monthly or yearly subscription.
### 4.2 Payment & Billing
Payment will be charged to your Apple ID account (or Google Play account) at confirmation of purchase. We do not directly process or store payment card details.
### 4.3 Auto-Renewal & Renewal Charges
- **Auto-Renewal:** Subscriptions automatically renew unless auto-renew is turned off or cancelled at least 24 hours before the end of the current billing period.
- **Renewal Charge:** Your account will be charged for renewal within 24 hours prior to the end of the current period at the rate of your selected subscription plan.
- **Managing Subscriptions:** You can manage your subscription and turn off auto-renewal at any time by going to your Apple ID Account Settings (or Google Play Subscriptions) after purchase.
### 4.4 Free Trials
Any unused portion of a free trial period, if offered, will be forfeited when you purchase a subscription, where applicable.
### 4.5 Refunds
Refund requests are handled directly by Apple or Google according to their respective refund policies. We do not process refunds directly.

## 5. AI-Powered Features
### 5.1 Coin Identification & Valuation
The App uses AI (Google Gemini) to identify coins, estimate grades, and provide market valuations based on photos you submit. These results are **estimates only** and should not be relied upon as professional appraisals.
### 5.2 No Guarantee of Accuracy
We do not guarantee the accuracy, completeness, or reliability of any AI-generated identification, grade, or valuation. AI results may be incorrect, especially for rare, damaged, or unusual coins. You acknowledge that:
- AI-estimated grades are not equivalent to professional grading (e.g., PCGS, NGC)
- AI-estimated values are approximate and may not reflect actual market prices
- Coin identification may be inaccurate, particularly for obscure or ancient coins
### 5.3 Not Financial Advice
Nothing in the App constitutes financial, investment, or professional numismatic advice. You should consult qualified professionals before making purchasing, selling, or investment decisions based on information from the App.

## 6. User Content
### 6.1 Your Content
You retain ownership of all content you create and upload to the App, including photos, posts, comments, and collection data ("User Content").
By posting User Content to public areas of the App (community feed, comments), you grant us a non-exclusive, worldwide, royalty-free license to display, distribute, and make available your User Content within the App for the purpose of operating the service. This license ends when you delete the content or your account.
### 6.2 Content Standards
You agree not to post content that:
- Is illegal, harmful, threatening, abusive, harassing, defamatory, or obscene
- Infringes on any third party's intellectual property, privacy, or other rights
- Contains spam, advertising, or promotional material not authorized by us
- Impersonates any person or entity
- Contains malware, viruses, or other harmful code
### 6.3 Content Moderation
We reserve the right to remove any User Content that violates these Terms, without prior notice. We may also suspend or terminate accounts that repeatedly violate content standards.
### 6.4 Reporting & Blocking
You may report content or users that violate these Terms. You may also block other users to prevent seeing their content. We review reports and take action at our discretion.

## 7. Acceptable Use
You agree not to:
- Use the App for any unlawful purpose
- Attempt to gain unauthorized access to the App, its servers, or other users' accounts
- Reverse-engineer, decompile, or disassemble the App
- Use automated tools (bots, scrapers) to access the App
- Interfere with or disrupt the App's operation
- Circumvent any security features or access restrictions
- Use the App to facilitate fraud, including misrepresenting the value or authenticity of coins

## 8. Intellectual Property
### 8.1 Our Rights
The App, including its design, code, AI models, branding, and all related materials, is owned by Apex Consulting AB and protected by copyright, trademark, and other intellectual property laws. "Numi" and the Numi logo are trademarks of Apex Consulting AB.
### 8.2 Limited License
We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes in accordance with these Terms.

## 9. Privacy
Your use of the App is also governed by our Privacy Policy, which describes how we collect, use, and protect your data. By using the App, you consent to the practices described in the Privacy Policy.

## 10. Third-Party Services
The App integrates with third-party services including Firebase (Google Cloud), Google AdMob, Google Sign-In, Apple Sign-In, and Apple/Google app stores. Your use of these services is subject to their respective terms and privacy policies. We are not responsible for the practices of third-party services.
### 10.1 Apple App Store Additional Terms
If you downloaded the App from the Apple App Store, you acknowledge and agree that:
- These Terms are between you and Apex Consulting AB only, not Apple, Inc. ("Apple").
- Apex Consulting AB, not Apple, is solely responsible for the App, its content, maintenance, support, and addressing any claims relating to it.
- Apple has no obligation whatsoever to furnish any maintenance and support services with respect to the App.
- In the event of any third-party claim that the App or your possession and use of the App infringes that third party’s intellectual property rights, Apex Consulting AB, not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of any such claim.
- Apple and Apple’s subsidiaries are third-party beneficiaries of these Terms. Upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.

## 11. Disclaimer of Warranties
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not warrant that:
- The App will be uninterrupted, secure, or error-free
- AI identification, grading, or valuation results will be accurate or reliable
- Data stored on our servers will not be lost or corrupted
- The App will be compatible with all devices or operating systems

## 12. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, APEX CONSULTING AB SHALL NOT BE LIABLE FOR:
- Any indirect, incidental, special, consequential, or punitive damages
- Any loss of profits, data, or business opportunities
- Any financial loss arising from reliance on AI-generated valuations or grades
- Any damages exceeding the amount you have paid us in the 12 months preceding the claim
This limitation applies regardless of the legal theory on which the claim is based, whether in contract, tort, negligence, strict liability, or otherwise.
Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded under applicable law.

## 13. Indemnification
You agree to indemnify and hold harmless Apex Consulting AB, its officers, directors, and employees from any claims, damages, losses, or expenses (including legal fees) arising from:
- Your use of the App
- Your violation of these Terms
- Your User Content
- Your violation of any third party's rights

## 14. Termination
### 14.1 By You
You may stop using the App at any time. You may delete your account through Settings.
### 14.2 By Us
We may suspend or terminate your access to the App at any time, with or without cause, including if you violate these Terms. Upon termination, your right to use the App ceases immediately.
### 14.3 Effect of Termination
Upon termination, Sections 6.1 (ownership of your content), 11 (disclaimers), 12 (limitation of liability), 13 (indemnification), and 15 (governing law) survive.

## 15. Governing Law & Disputes
These Terms are governed by the laws of **Sweden**, without regard to conflict of law principles.
Any dispute arising from or relating to these Terms or the App shall be resolved by the courts of Sweden. For consumers residing in the EU, nothing in these Terms affects your right to bring proceedings in the courts of your country of residence or to use the EU Online Dispute Resolution platform at https://ec.europa.eu/consumers/odr.

## 16. Changes to These Terms
We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms within the App. Your continued use of the App after changes are posted constitutes acceptance of the revised Terms. If you do not agree to the updated Terms, you must stop using the App.

## 17. Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

## 18. Entire Agreement
These Terms, together with the Privacy Policy, constitute the entire agreement between you and Apex Consulting AB regarding the App and supersede any prior agreements.
